SEXUAL HARASSMENT IN CONNECTICUT’S PUBLIC
HIGH SCHOOLS
Executive Summary
exual harassment is a form of sex discrimination. It is
unlawful under Title VII of the 1964 Civil Rights Act
and Title IX of the 1972 Education Amendments. With
the aim of documenting the extent of the problem in
this state, and of guiding policy makers and educators
toward ensuring a healthy and fair school environment, surveys of
students and Title IX Coordinators were implemented during the
1993-94 school year.
The Connecticut Permanent Commission on the Status of Women
(PCSW), in association with the University of Connecticut School of
Social Work, has completed statewide research assessing the inci
dence of sexual harassment in the states’ high schools.
In conjunction with the student survey, the Connecticut Sexual
Assault Crisis Services, Inc., (CONNSACS) surveyed Title IX Coor
dinators in Connecticut public schools, to obtain their observations
and opinions about sexual harassment in the schools.
We found sexual harassment to be pervasive. As a result, we are
recommending strategies for addressing the problem in Connecti
cut schools.

Key Findings
Student Survey:
Unwanted sexual behavior is pervasive among high school
students in Connecticut. Seventy-eight (78%) reported at
least one experience during their high school years.
•
Harassed students indicated feelings of “anger,” “embarrass
ment,” “nervousness” and “confusion”; some “skipped
school” and said their grades dropped; some “pretended it
didn’t happen” and some said it “was no big deal”.
•
Unwanted sexual behavior has been experienced by both
genders. Females experience this behavior far more often
than males: 92% of females and 57% of males have experi
enced harassment.
•
Thirteen (13) students from the sample schools reported
sexual harassment by teachers.

Forty percent (40%) of students told no one about the un
wanted sexual behavior they encountered at school.
Title IX Coordinator Survey:
I
Eighty-one percent (81%) of the reporting Title IX Coordina
tors received complaints from students who had been ha
rassed; 85% from females, 15% from males.

A majority of the harassers (76%) were students; 22% of the
complaints were about teachers.
•
Eighty-five percent (85%) of the complaints were resolved
within one month.

Nearly all (99%) of the districts reporting have sexual harass
ment policies; there is training for staff in a majority of these
schools.
I
Twenty-five percent (25% )of reports complained of sexual
touching; 1% attempted rape; and 1% completed rape.
These behaviors constitute criminal sexual assault.
I
Sexual harassment is considered a problem by 50% of Title
IX Coordinators in the survey; 37% said it is not a problem.

s a result of the data pointing to widespread un
wanted sexual behavior among students in Con
necticut high schools, the PCSW convened a series
of meetings with educators and women’s advocacy
groups to generate and recommend steps to be
taken to address the problem. Our recommendations follow:
Schools must make vigorous voluntary efforts to address
sexual harassment. Some steps they can take include:
A.
Develop and implement internal sexual harassment
policies which address all forms of sexual harassment
including peer to peer harassment, and methods for
following up with alleged harassers;
B.
Develop peer counseling and support centers to
encourage students to report sexual harassment
when it occurs;
C.
Provide sexual harassment training for administra
tors, staff, and students;
D.
Inform staff and students about resources available
for assistance when sexual harassment occurs.
II.
Pursue future strategies to assure high quality training about
sexual harassment for teachers and administrators in all
schools and to implement other activities to eliminate sexual
harassment, with adequate funding and resources.
III.
PCSW will convene a Statewide Sexual Harassment Task
Force with a one-year mandate.
The Sexual Harassment Task Force will, by January of 1996, de
velop and implement a strategic plan for effectively addressing
sexual harassment in schools.

The mission of this Task Force will be:

Identify and publicize model sexual harassment prevention
programs in Connecticut;
H
Determine methods for creating a climate of zero tolerance
for sexual harassment;
H
Determine strategies for expanding the commitment of
resources for addressing sexual harassment in schools;
H
Create an ongoing community dialogue among stakeholders
to assist in expanding awareness and knowledge of sexual
harassment issues.
Membership in the Sexual Harassment Task Force will include
representatives of at least the following organizations:

Permanent Commission on the Status of Women (PCSW) and the Commission on
Human Rights and Opportunities (CHRO) as a public service. Individuals and
organizations are invited to provide information about their services. Neither PCSW
or CHRO has screened or in any way evaluated the sexual harassment prevention
training provided by those listed. Neither PCSW or CHRO endorses the trainers
listed or certifies the services provided as appropriate. Training consultants not listed
may also be willing and qualified to provide sexual harassment prevention training.
We are pleased to provide this list in order to assist employers in complying with
C.G.S. 46a-54-200-46a-54-207. This state law requires all employers with 50 or
more employees to provide at least 2 hours of sexual harassment prevention re
sponse training to all current supervisors and new supervisors within 6 months of
hire or promotion to a supervisory position. The state regulations, as well as a
sample poster for your workplace, and Historical Statistics for Sexual Harassment
Caseload, are attached as Appendices.

Section 46a-54-200. DEFINITIONS
For purposes of sections 46a-54-200 through 46a-54-207, inclusive:
(a) ‘Sexual Harassment” means any unwelcome sexual advances or requests for sexual favors or any
conduct of a sexual nature when 1) submission to such conduct is made either explicitly or implicitly a term or
condition of an individual’s employment, 2) submission to or rejection of such conduct by an individual is used as
the basis for employment decisions affecting such individual, or 3) such conduct has the purpose or effect of
substantially interfering with an individual’s work performance or creating an intimidating, hostile or offensive
working environment.
(b) “Employer” includes the state and all political subdivisions thereof, including the General Assembly,
and means any person or employer with three or more persons in his employ.
(c) “Employer Having Fifty or More Employees” means the state and all political subdivisions thereof,
including the General Assembly, and means any person or employer who has a total of fifty or more persons,
including supervisory and managerial employees and partners, in his employ for a minimum of thirteen weeks
during the previous training year.
(d) “Employee” means any person employed by an employer, but shall not include any individual
employed by his parents, spouse or child, or in the domestic service of any person.
(e) “Supervisory Employee” means any individual who has the authority, by using her or his
independent judgment, in the interest of the employer, to hire, transfer, suspend, lay off, recall, promote,
discharge, assign, reward or discipline other employees, or responsibility to direct them, or to adjust their
grievances or effectively to recommend such actions.
(f) “Commission” means the Commission on Human Rights and Opportunities created by section 46a52 of the Connecticut General Statutes.
(g) “Trpining year” means the period of time from October first in any calendar year through September
thirtieth in the following calendar year.
Section 46a-54-20L POSTING REQUIREMENT FOR EMPLOYERS HAVING THREE OR MORE
EMPLOYEES
(a) Employers with three or more employees must post notices to employees concerning the illegality of
sexual harassment and remedies available to victims of sexual harassment.
(b) Such information shall include, but is not limited to:
(1) The statutory definition of sexual harassment and examples of different types of sexual
harassment;
(2) Notice that sexual harassment is prohibited by the State of Connecticut’s Discriminatory
Employment Practices Law, subdivision (8) of subsection (a) of section 46a-60 of the Connecticut
General Statutes;
(3) Notice that sexual harassment is prohibited by Title VII of the 1964 Civil Rights Act, as
and
amended, 42 United States Code section 2000e .
(4) The remedies available, including but not limited to:
(A) Cease and desist orders,
(B) Back pay,
(C) Compensatory damages, and
(D) Hiring, promotion or reinstatement;
(5) Language to the effect that persons who commit sexual harassment may be subject to civil
or criminal penalties;
(6) The address and telephone number of the Connecticut Commission on Human Rights and
Opportunities; and
(7) A statement that Connecticut law requires that a formal written complaint be filed with the
Commission within one hundred and eighty days of the date when the alleged sexual harassment
occurred; and
(8) Any and all notices so posted will have the heading, “SEXUAL HARASSMENT IS
ILLEGAL,” in large bold-faced type.
(c) The Commission strongly recommends, but does not require, that the poster include:
(1) A statement concerning the employer’s policies and procedures regarding sexual harassment
and a statement concerning the disciplinary action that may be taken if sexual harassment has been
committed; and
(2) A contact person at the place of employment to whom one can report complaints of sexual
harassment or direct questions or concerns regarding sexual harassment;
�(d) A model poster is appended to these regulations.
Section 46a-54-202. WHERE TO POST
Employers must place, and keep posted, notices in prominent and accessible locations upon its
premises where notices to employees are customarily posted. Notices must be posted at each employer facility
in such a manner that all employees and applicants at that facility will have the opportunity to see the notices
on a regular basis.
Section 46a-54-203. WHEN TO POST
(a) All employers with three or more employees shall post notices as soon as practicable after the
effective date of these regulations, but no later than forty-five (45) days after the effective date of these
regulations.
(b) An employer shall promptly replace notices that are removed, destroyed or defaced.
Section 46a..54.204. POSTING AND TRAINING REQUIREMENTS FOR EMPLOYERS HAVING FIFTY
OR MORE EMPLOYEES
(a) An employer having fifty (50) or more employees shall comply with the posting requirements set
forth in sections 46a-54-200 through 46a-54-207, inclusive.
(b) An employer having fifty (50) or more employees must also provide two hours of training and
education to all supervisory employees of employees in the State of Connecticut no later than October 1, 1993 and
to all new supervisory employees of employees in the State of Connecticut within six months of their assumption
of a supervisory position. Nothing in these regulations shall prohibit an employer from providing more than two
hours of training and education.
(c) Such training and education shall be conducted in a classroom like setting, using clear and
understandable language and in a format that allows participants to ask questions and receive answers. Audio,
video and other teaching aides may be utilized to increase comprehension or to otherwise enhance the training
process.
(1) The content of the training shall include the following:
(A) Describing the federal and state statutory provisions prohibiting sexual harassment
in the work place with which the employer is required to comply, including, but not limited to,
the Connecticut discriminatory employment practices statute (section 46a-60 of the Connecticut
General Statutes) and Title VII of the Civil Rights Act of 1964, as amended (42 U.S.C. section
2000e, and following sections);
(B) Defining sexual harassment as explicitly set forth in subdivision (8) of subsection (a)
of section 46a-60 of the Connecticut General Statutes and as distinguished from other forms of
illegal harassment prohibited by subsection (a) of section 46a-60 of the Connecticut General
Statutes and section 3 of Public Act 9 1-58;
(C) Discussing the types of conduct that may constitute sexual harassment under the
law, including the fact that the harasser or the victim of harassment may be either a man or a
woman and that harassment can occur involving persons of the same or opposite sex;
(D) Describing the remedies available in sexual harassment cases, including, but not
limited to, cease and desist orders; hiring, promotion or reinstatement; compensatory damages
and back pay;
(E) Advising employees that individuals who commit acts of sexual harassment may be
subject to both civil and criminal penalties; and
(F) Discussing strategies to prevent sexual harassment in the work place.
(2) While not exclusive, the training may also include, but is not limited to, the following elements:
(A) Informing training participants that all complaints of sexual harassment must be
taken seriously, and that once a complaint is made, supervisory employees should report it
immediately to officials designated by the employer, and that the contents of the complaint are
personal and confidential and are not to be disclosed except to those persons with a need to
know;
(B) Conducting experiential exercises such as role playing, coed group discussions and
behavior modeling to facilitate understanding of what constitutes sexual harassment and how
to prevent it;
(C) Teaching the importance of interpersonal skills such as listening and bringing
participants to understand what a person who is sexually harassed may be experiencing;
(D) Advising employees of the importance of preventive strategies to avoid the negative
effects sexual harassment has upon both the victim and the overall productivity of the work
place due to interpersonal conflicts, poor performance, absenteeism, turnover and grievances;
(E) Explaining the benefits of learning about and eliminating sexual harassment, which
include a more positive work environment with greater productivity and potentially lower
exposure to liability, in that employers--and supervisors personally--have been held liable when
it is shown that they knew or should have known of the harassment;

�(F) Explaining the employer’s policy against sexual harassment, including a description
of the procedures available for reporting instances of sexual harassment and the types of
disciplinary actions which can and will be taken against persons who have been found to have
engaged in sexual harassment; and
(G) Discussing the perceptual and communication differences among all persons and, in
this context, the concepts of “reasonable woman” and “reasonable man” developed in federal
sexual harassment cases.
(d) While not required by these regulations, the Commission encourages an employer having
fifty (50) or more employees to provide an update of legal interpretations and related developments
concerning sexual harassment to supervisory personnel once every three (3) years.
Section 46a.54-205. EFFECT OF PRIOR TRAINING
An employer is not required to train supervisory personnel who have received training after October 1,
that:
1991
(1) substantially complies with the required content of the trsining set forth in subsection (cXl)
of section 46a-54-204; and
(2) was provided in a classroom setting and lasted at least two hours.
Section 46a-54-206. TRAINERS
An employer required to provide training by these regulations may utilize individuals employed by the
employer or other persons who agree to provide the required trRining, with or without reimbursement.
Section 46a-54-207. RECORDKEEPING
(a) The Commission encourages each employer required to conduct trpining pursuant to Public Act 9285 to maintain records concerning all trsining provided.
(b) Such records may include, but are not limited to:
(1) documents sufficient to show the content of the training given, such as the curriculum;
(2) the names, addresses and qualifications of the personnel conducting the training;
(3) the names and titles of the personnel trained and the date or dates that each individual
was trained;
(c) The Commission encourages employers to maintain any such records for a minimum of one year, or if
a discriminatory practice complaint is flied involving personnel trained, until such time as such complaint is
finally resolved.

And Is Prohibited By The Connecticut Discriminatory Employment Practices Act (Section 46a-60(AX8) Of The Connecticut
General Statutes) And Title VU Of The Civil Rights Act Of 1964 (42 United States Code Section 2000e
Sexual Harassment means “any unwelcome sexual advances or requests for sexual favors or
any conduct of a sexual nature when:
Submission to such conduct is made either explicitly or implicitly a term or condition
(1)
of an individual’s employment;
(2)
Submission to or rejection of such conduct by an individual is used as the basis for
employment decisions affecting such individual; or
(3)
Such conduct has the purpose or effect of substantially interfering with an
individual’s work performance or creating an intimidating, hostile or offensive
working environment.”
Examples of Sexual Harassment include: unwelcome sexual advances, suggestive or lewd
remarks, unwanted hugs, touches, kisses: requests for sexual favors, retaliation for complaining
about sexual harassment; derogatory or pornographic posters, cartoons or drawings.
Remedies for Sexual Harassment may include: cease and desist orders, back pay,
compensatory damages, hiring, promotion or reinstatement. Individuals who engage in acts of
sexual harassment may also be subject to civil and criminal penalties.

he Commission on Human Rights and Opportunities receives numerous requests for
historical statistics on the Commission’s sexual harassment caseload. Because the corn
plaints are now tracked by “cases” rather than “allegations” in the agency’s reports, there
have been gaps in the comparative data from previous years. The following data de

creatures, or you could be one of several
clowns, a gorilla, gargoyle, or vampire.Too
common? How about a face that looks like
it's melting, or an ugly mug with a grotesque
little monster popping out of the skull?
Perhaps you'd like the hideous little critter
protruding from the eye socket? A little toe,
gross? Disguise yourself with a caricature
of a Maine fisherman, pirate, chef, swami,
or Japanese aviator. You could impersonate
Ronald Reagan, Bozo the Clown, Laurel or

Halloween is the second biggest party
night of the year, after New Year's Eve, and

Mel Goldberg admits "we make some really
disgusting stuff'' - T opstone is riding the
crest of a Halloween mania that has swept
the nation over the last five years.
Both Topstone's headquarters on Sand
Pit Road in Danbury, and Goldberg belie
the company's spooky business, and reflect
more its international image. Nestled on a
ten-acre, $4.2 million campus, business is
conducted in a modern building with lots of
glass and skylights surrounded by rolling
green lawns and woods. Goldberg is a
quiet, pleasant man who enjoys working
with plants. He created the Japanese garden
that graces the company's front entrance,

and a rocky display of foliage plants set off
to the side. Inside, the reception area is
quiet and comfortable, offices are spacious,
and only a gallery of artistic movie posters
- one depicts Dracula, another Boris
Karloff - gives away the company's stock
in trade.
Topstone provides one-stop shopping
for the Halloween retailer. A customer can
deck herself out from head to toe from
T opstone's line. In addition to the disguises
mentioned above, there are masks with
feathers, sequins, and fake fur. There are
false beards and mustaches. Wigs of every
color and style are available. Pick from
assorted body parts: ears, noses, tusks,
hands, paws, feet, and tails. Even a witch
isn't just a witch anymore. Not when she
shines from head to toe with a lavish
application of glitter lipstick and glow-inthe-dark pantyhose. Need something to Sally Governale Is vice president, special products. She not only

But there is more to Topstone's masks
and costumes than meets the eye. Safety is
uppermost in Goldberg's mind, from the
products he sells to the warehouse where
they are stored.
"As an industry, we stress safety,"
Goldberg said. "We are working on highintensity lighting to integrate into our
costumes. We call it 'see-curity.' We've also
worked on flame-retardant clothing," he
added. "I don't want to see children hurt."
Sometimes an increase in safety can
mean a little less profit. T opstone offers no
red face make-up since that pigment contains a skin irritant, and the company
shows no designs that encourage people to
paint their entire faces. "We are not a prime
source of Halloween cosmetics," Goldberg
admits.
He also won't carry "blood capsules" regular gelatin capsules containing fake
blood. You pop one in your mouth, bite
down, and the result is you look like you're
bleeding from the mouth. Goldberg objects
to this item because it looks too much like
real medicine. "I'm very much against the
use of drugs, and with this, a child could
pick up his mother's prescription medicine
at a later date, and not know what it is," he
explained. "My feeling is, let's make toys
that look like toys.''

It wasn't so long ago that Goldberg and
others in the industry thought Halloween
might suffer a major setback. It was right
around the holiday, in the early 1980s that
the original Tylenol tampering incident
occurred. As a result, many parents were
reluctant to let their children go out trickor-treating. "We thought Halloween was
dead," Goldberg recalled, "But we were
wrong." People began having more parties,
and both children and adults started
dressing up more than ever. But instead of
appropriating Dad's worn jacket as the
st~rt of a hobo outfit, or getting creative
with an old sheet, adults and children were
putting on the dog, so to speak, from top to
bottom.

When Danbury was still in the hat business, T opstone manufactured its own products. Even up until five years ago, most of
the masks were made in this country. But
T opstone has gone multi-national, and all
products are imported from Taiwan, Korea,
the Philippines, Mexico, China, Hong Kong,
and Thailand. To do otherwise could price
T opstone out of business.
"There is a lot of hand labor involved in
our products," Goldberg said. "From a
labor and environmental point of view, it is
difficult to make them in this country."
T opstone's client list is also multi-national.
Party shops, dime stores, seasonal merchandisers, and department stores in the
U.S., Australia, South America, and Hong
Kong carry T opstone's products. The company will sell to any merchandiser, large or
small, and has no minimum order. Selling is
divided among two sales teams. With a
national sales office in New Yor~ City, one
group acts as a sales management team
and handles major accounts. The second
group is made up of independent reps
across the country.
Within the company itself are 35 full-time
employees, although that number willswell
to 100 in the summer when Halloween
items are being shipped. Four people, in
addition to Goldberg, make up the
management team: Steve Feldman, senior
vice president; Sally Governale, vice presi-.
dent in charge of the art department; Al
Cusumano, controller; and Scott Fraistat,
who oversees the international, credit, and
collection divisions.
For his own part, Goldberg has worn all
the hats at one time or another - from the
loading dock to product development.
These days, in addition to running the
company, he sticks primarily to creating
new products and indulges his favorite

hobby by acting as in-house photographer.
Last summer he shot the 1989 catalog with
a crew of local children modeling costumes.
He also travels extensively on buying trips
and leaves every six weeks for a three-week
trek, often to the Orient. The only job he
resolves not to do anymore is selling. "I'm
too attached to my products," he confessed.
But the sales team is doing a good job by
itself, and Topstone needs to expand its
108,000-square-feet on Sand Pit Road (a
separate warehouse in Danbury is 75,000square-f eet.) Goldberg thinks another
35,000-square-feet will hold them for five
more years, but because of bureaucratic red
tape, he doesn't expect to break ground
until 1990.
Goldberg appears to have accepted a
give and take philosophy to business. He
could immediately increase profits by
moving the company to the West Coast,
because that's where the products arrive
from the Far East. "But I like to live here,"
he said, referring to his home in Fairfield.
His wife is a "budding actress" in New
York, and his children attend Eastern colleges. "We price our products as though we
are on the West Coast, and we give up
several hundred thousand dollars in profit
that way," he explained because of the
need to ship things East, and then ship
them back to West Coast clients.
"But it's worth it," he said matter-offactly. "We're successful enough."

And this has been nothing but good for
Topstone's bottom line. The company's
product catalog for 1989 is 80 pages long,
up from 20 pages just five years ago. In that
short time, fical growth has soared 25
percent a year. Coincidentally or not that
is when Goldberg took over T opston~.
T opstone has been in the Halloween
business for more than half a century. The
company originated in an old cider mill on
T opstone Drive, off Route 7 in Ridgefield. It
was an area known at the time as T opstone,
Connecticut. From there, the company
moved to Bethel and then to Danbury.
Goldberg arrived at Topstone in 1961 to
help run things for a company that had a
financial stake in_it.At the time, Topstone
occupied 12,000-square-feetand had a yearly
sales volume of between $300,000 and
$400,000.
After a few moves in Danbury, T opstone
settled into its present location in 1986. It
now occupies 185,000-square-feet, with an
annual sales volume in the millions.
Goldberg also diversified T opstone by
branching out into other holidays Valentine's Day, St. Patrick's Day, Mother's
Day, and Easter. A separate catalog features
baskets, bunnies, Easter eggs, balloons,
toys, and "Kiss me, I'm Irish" buttons. The
spring holiday line accounts for 25 percent
of Topstone's business.
